Competition Law

Interestingly the competition law in all Baltic states has grown from initial, EU-initiated formal merger control into a more aggressive supervision of market behaviour. Competition law no longer is a formal, abstract concept but a real set of rules that is enforced on market participants.

Companies cannot afford to ignore the competition rules, whether they are undertaking a merger, joint venture or acquisition, participating in an association with their competitors or entering into distribution or licensing agreements.

Our experience involves:

  • Application of national merger control rules, including managing the regulatory process before the Competition bodies in the Baltic States
  • Notification of transactions to the regulator in order to seek clearance where this is necessary
  • Negotiating of terms such as exclusivity, non-competition and pricing in the light of the competition rules
  • Making complaints to the authorities about abuse of dominance and defending such allegations of competitors
  • Defence of companies and their management in cartel proceedings.
